The Design N Print Site is provided free of charge for your convenience. In consideration for this we require that you agree to the following terms ('the Terms') for use of the Site. If you do not agree to the terms please cease using this site. If you continue to use the Site you are agreeing to the terms that appear below, together with any specific terms set out on individual pages within the Site. The Terms (including any amendments made by Design N Print) will continue in force until such time as they are terminated. For details of how to terminate, please see below.

This Site is not intended to be accessed or used by users in countries other than the United Kingdom and Ireland and no representation or warranty is made as to whether the information available in this Site complies with the regulatory regime of other countries.

TERMINATION

If either Design N Print or you wish to terminate the agreement between us this can be done by sending an e-mail by us to your e-mail address and by you to a href="mailto:info@designNprintdirect.com">info@designNprintdirect.com or by post by us to your usual address and by you to our registered office as given above. Notices will be deemed to have been served one hour after transmission by e-mail and 3 working days after despatch by post. You are responsible for notifying Design N Print of any change to your e-mail address and where provided to us, your postal address.

Any breach of the Terms shall entitle Design N Print immediately to terminate the service to you without notice. If you would like us to let you know our reasons for terminating the agreement between us, please contact us at info@designNprintdirect.com

INTELLECTUAL PROPERTY

Unless otherwise stated, any intellectual property rights arising in respect of this Site's design, text, graphics, its selection and arrangement, software and all other material (the 'Content') on or in this Site belong to Design N Print and/or its licensors. Any use of such intellectual property rights or software or any reproduction of the Content is strictly prohibited except where expressly allowed under the Terms.

Permission is hereby granted electronically to copy and store (but not on any server or other storage device connected to a network) and print individual pages of the Content on paper (but not photocopy them) from this Site only for the purpose of making use of our services. You may also permit your computer to make an electronically stored, transient copy of the Content for the purpose of viewing it while connected to the Internet only. However you may only make one copy of the Content. Any other use of the Content, including reproduction for purposes other than that hereby authorised (including the removal of copyright or trade mark notices), creation of an electronic or manual database by systematically downloading and storing the Content, distribution (whether electronically or not) or republication is prohibited.

This Site may contain material, including advertising and sponsorship, which originates from third parties. Those third parties are responsible for that material. It is the responsibility of such advertisers, sponsors and other third parties to ensure that such material complies with all relevant laws and regulations.

Please note that we have no control over and are not responsible for the content of linked web sites and accordingly make no warranty or representation as to their contents. ILLEGAL USE

You may only use the Site for lawful purposes. You must not illegally transmit, distribute or store any material or violate any applicable regulation. This includes, without limitation, material which is protected by copyright, trade mark, trade secret or intellectual property right which you use without permission.

You may not circumvent or attempt to circumvent Design N Print 's security systems by 'cracking', 'hacking' or otherwise.

In the interests of all our users, Design N Print will co-operate with investigations by any law enforcement or relevant authorities of suspected criminal activity or violation of systems or network.

We take the issue of data protection very seriously. Our policy is set out in our Privacy Statement. So that we may comply with our obligations under Data Protection legislation, you are required to read and agree to the Privacy Statement before providing us with any information about yourself. Failure to do so is a breach of the Terms.

It is your responsibility to make sure that information which we hold about you is up to date and accurate. Failure to do so will be a breach of the Terms.

CHANGES

Design N Print reserves the right, at its discretion, to modify, add to or change the Site, the Terms, our Privacy Statement and any other policies at any time and any such modifications, additions or changes will be effective immediately on being posted to this Site. When such modifications, additions or changes are made to the Terms, the Privacy Statement or any other policies, this will be indicated by the issue date at their start. It is your responsibility to make sure that you are aware of any such modifications, additions or changes and you will be deemed to have accepted them if you access the Site after any modifications, additions or changes have been made.

We will do our best to ensure that the Site is what we believe to be relevant, up to date and as interesting as possible and we accordingly reserve the right, at our discretion, to make changes to any part of this Site.

DISCLAIMER OF WARRANTY AND LIABILITY

Design N Print makes no express or implied warranty or representation:

• as to the accuracy, completeness, fitness for any particular purpose or currency of the information accessible via this Site and we request that wherever possible, you verify data which is available on the Site with an independent source;
• that the Content is free from viruses or anything else that has contaminating or destructive properties including where such viruses or other programmes result in loss of or corruption to your data or other property; or
• as to the operation, quality, functionality or accessibility of the Site.

Whilst we will do our best to maintain the operation of the Site in accordance with this agreement, we will not be responsible for the computer equipment and telephone services which you use to access the Site. Please also note that the Site will on occasion be unavailable because of maintenance and repair works which we carry out on the Site. We will make reasonable efforts to ensure that downtime for maintenance and repair works is kept to a minimum.

No other warranties, conditions, undertakings, representations, terms or other liabilities whether express or implied, statutory or otherwise (if any) arising out of or in connection with use of (or inability to use) the Site or any material on the Site or any action or decision taken as a result of using the Site or any material on it are given.

We will only be liable for any loss or damage which you suffer from your use of the Site which results directly from our breach of this agreement or from our negligence and which loss or damage was foreseeable (i.e. it was obvious) to you and us at the time of entering into this agreement and where your use of this Site is for business purposes we will not be liable for any loss of business, profits, contracts, goodwill and/or any other indirect economic loss.

We will not be liable for the content of any third party websites or the actions or omissions of their proprietors nor for the contents of third party advertisements and sponsorship which may appear on the Site.

Any liability of Design N Print shall be limited in respect of any one incident or a series of two or more connected incidents to an amount equal to £100.

Any claim for loss or damage caused by us which you wish to make must be notified to us as soon as practicable after the loss or damage is discovered.

In the event of any claim against us by a third party resulting from use of the Site by you, you will be responsible for and indemnify us against all of our losses, damages and reasonable costs and expenses. In the event of a third party claim against us, you agree that you will:

• give us full authority to conduct the matter, including as to defending or settling the matter; and
• give us all reasonable assistance which we require from you in relation to the matter.

The above exclusions and limitations shall not, however, operate so as to limit the liability of Design N Print in respect of death or personal injury arising from the negligence of Design N Print or that of its employees, agents or sub-contractors. Except as expressly stated, nothing in these Terms will reduce your statutory rights relating to the manner in which we perform this agreement.

CHOICE OF LAW AND JURISDICTION

The Terms shall be governed by, and construed in accordance with, English law. We both agree, for the exclusive benefit of Design N Print, that the Courts of England shall have the exclusive jurisdiction to determine any disputes which may arise out of, under, or in connection with this Agreement; save that, it is agreed that this clause confers jurisdiction for the benefit of Design N Print only and Design N Print shall reserve the right to bring proceedings against you in the Courts of any other country, which has jurisdiction.

GENERAL

You may not assign, sub-license or otherwise transfer any of your rights under the Terms. If any provision of the Terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of the Terms, which shall remain in full force and effect. Failure by either party to exercise any right or remedy under the Terms does not constitute a waiver of that right or remedy. Headings in these Terms are for convenience only and will have no legal meaning or effect. The Terms cannot be varied except in writing by a director of Design N Print. Nothing said by any employee or agent of Design N Print will be capable of varying the Terms.

Design N Print take the issue of Data Protection very seriously. We have therefore produced this privacy statement to describe the practices that are employed within this websites (the " Design N Print Websites") in order to gather, store and utilise personal information.

Please note that by providing your personal information (including your contact details) to the Design N Print Website, you are indicating your agreement to allow this information to be used by Design N Print ("the Design N Print Group" or "we").

Collection and Use of your personal information

Design N Print will not capture or record personal information without your knowledge and will only collect it for the following purposes:

• To allow Design N Print to follow-up requests you make on the Design N Print websites and/or any other websites operated by Design N Print. For example, contact information will be required when you request a quotation or when you register to use the VIP online ordering and management information system.
• To inform you about goods, services, promotions or competitions which we think may interest you. If you would like us to provide you with such information from time to time, please provide us with your details by sending them to the contact details on our 'Contact Page' indicating the manner in which you would prefer to be contacted. We will only contact you in a specific manner if you have provided us with your details to do so.

From time to time we will request information from visitors to the Design N Print Websites as part of online surveys or contests. Participation in these surveys and contests is completely voluntary so visitors can choose whether or not to disclose personal information. Typically information requested for surveys and contests may include contact information (such as name, address and telephone number) and demographic information (such as postal code, age and job title). Contact information will be used to notify winners so that, if appropriate, prizes can be awarded. A winner's name may also be published on our websites. Survey information will be used to monitor and improve the use and satisfaction of the Design N Print Group websites.

Collection of Other Information

The Design N Print Websites will automatically record the IP addresses presented by computers browsing the website. This information will be aggregated to allow the Design N Print Group to analyse browsing trends, to track commonly visited pages and to improve the facilities offered by the Design N Print Websites through understanding how it is most commonly used. IP addresses are not linked to personal information and cannot be used to identify any single individual visiting the site.

Where we Store Your Personal Data

All information you provide to us is stored on (our) secure servers. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transaction is at your own risk. The Design N Print websites may use cookies for collecting user information from websites. Additionally some areas of the websites do store session information on your machine in cookie form. These details are used to enable our web server to keep track of your connection; they do not contain any references to your personal information and are set to expire once your session has ended.

Please note that if you communicate with us electronically, including by e-mail, this communication may be randomly monitored and/or recorded to protect the interests of our business and our customers.
